not doing their job. but rarely if ever do those threats result in the murder of not one but two prosecutors. hello and welcome to justice. i'm judge jeanine pirro. thanks for joining us tonight. on january 31 top felony prosecutor mark hassey of the kaufman county d.a.'s office in texas was gunned down in the parking lot on his way to the courthouse. and less than two months later his boss district attorney mike mcclelland and his wife cynthia were shot and killed in their own home. this week in an unprecedented move assistant u.s. attorney jay heilman from the southern district of texas withdrew from the very case the kaufman county d.a.'s office worked on, citing his own security concerns. throughout the history of the

country d.a.s have been virtually immune from any kind of violence. even the bad guys have rules, a moral code that you just don't kill certain people. >> what are you going to do? nice college boy, huh? don't want to get mixed up in the family business. now, you you want to gun down a policeman? >> where does it say you can't kill a gop. >> judge jeanine: the case doesn't fold. everyone knows if you kill one prosecutor there are more that will simply replace them to try that case. in fact, in the last century there have been just 13 murders of american prosecutors. some of them not even related to their work as d.a.s. yet in places like mexico, colombia and sicily violence against law enforcement can be a daily fare. the murder of police, prosecutors and judges is a way of life. a way to rule the courts. a way to control the criminal justice system.

the message is an unmistakable one. don't mess with us. so why is this happening in the united states now? before his brutal murder, d.a. mcclelland was a chief law enforcement officer through of county through which interstate 20 a known drug corridor ran. his office was part of a statewide drug task force whose office culminated in the indictment of 34 members of the ariya brotherhood of texas. it wasn't the first time this d.a. battled the brotherhood. at the end of last year he won a convict ision where two life sentences were mete the out and a statewide bulletin issued to law enforcement officials including kaufman county that the aryan brotherhood was

planning revenge. now, you to most of us the aryan brotherhood in texas or anywhere else is simply a violent wheel supremacist racist gang. is this about racial hatred? i see something different. i see and i think that white supremacy has very little to do with these murders. when you peel back the layers of the onion, and actually he read the federal indictment against those 34 members of aryan brotherhood texas the charges are racketeering. okay. an organized crime. white supremacy gang charged with racketeering. but why? peel back again. these individuals are charged with murders, attempted murders. kidnappings. assaults and con spear arecy. for what? -- conspiracy. for what? conspiracy to distribute methamphetamine and cocaine.

transport illicit goods and execute rival drug traffickers. they he are identified as hitmen and narcotics traffickers for the mexican drug cartels. one leader just recently admitted to bringing hundreds and hundreds of pounds of methamphetamines into texas for the mexican drug cartel. clearly there is more to this than white supremacy. is it possible the mexican drug cartels are moving into the united states and enforcing justice the way they do in their own country? is it possible that the murders of these prosecutors was part of a message, a message that the line in the sand between a civilized and lawless society has been erased? with me now is the director, the ekimov ittive director of

the national d.a. association scott burns and former texas prison gang investigator maryan dinner and richard valdomar. scott, i will start with you. should d.a.s around the country be worried that a line has been crossed? >> it is shocking. we receive threats as prosecutors, you know that. you did it for decades. and we take them serious, but the good news is it is so rare for a prosecutor to actually be murdered. we have a monument down in columbia south carolina and thank god there is only 11 names on it, soon to be two more. this is unprecedented. >> judge jeanine: unprecedented scott and as you say we both understand. you have been elected d.a. i have been elected d.a. threats just go with the territory. two from one office within two months and then the united states attorney who was prosecuting the case that they

worked on is -- you know, he is teaing him isself off the case. what does that tell you? >> well, you you know, i received calls from all over the country prosecutors offering to go down there. as you know, we represent the criminal justice system and the rule of law and prosecutors take great pride in standing before judges like you and say the government is ready. and we cannot -- we cannot back down from these people. >> judge jeanine: marry ann i will go to you. you have been a gang prison investigator and worked in the prison system with the gang members. are these guys known to target law enforcement and their families? >> no, ma'am. this is totally uncharacteristic. totally uncharacteristic of abt members. >> judge jeanine: not just of abt members but of gang members in general. >> prison gang members, yes. it is not something at the top of their list. they know that is part of the

territory of them getting arrested and being prosecuted. and especially in a small town like that where everybody knows somebody they have been prosecuted probably in the same county. you know, by these people before. and there hasn't been a target on them, you you know, at that time. so why now? why would they do this now? this is just not them. >> judge jeanine: i don't know if any of us can say it is not them. it may not be typical of what they have done. >> it is not typical of them. >> judge jeanine: is this setting a precedent now for other gang members if, indeed, this is whether it is aryan brother of texas or other gangs. >> we are assuming it is aryan brotherhood of it texas. if it is they are going against what they normally believe. what they normally believe is killing a policeman or a prosecutor is not the good for business and so that is what the investigator was talking about. that is my experience as well. >> judge jeanine: you know what is interesting here is that,

you know, the texas authorities after that indictment that the kaufman county d.a.'s office worked on in the multistate task force the texas authorities said that abt had issued an alert, a threat i should say of retaliation against law enforcement. and that was intelligence that they had garnered. isn't that unusual, richard? >> yes, judge. and i would suspect that there was something more to that. it is not a normal course of their business. but if they feel insulted or if they feel demeaned, they would be required by their codes to make some kind of a statement and that statement would be violence. >> judge jeanine: all right. panel, stick around with us. we will have more on the texas prosecutor murders after the break. and later, north korean supreme leader vows to attack america. should we take this guy seriously? stay with us. today i'm announcing that my office is offering a cash reward of up to $100,000 for information leading to the capture and indictment of those responsible for the deaths of mr. and mrs. mcclelland as well as mr. hossey. >> judge jeanine: $100,000. now, $200,000 is a lot of money. will it be enough to get someone to turn in those responsible for these murders? we are back with the executive the nationalhe international district attorney's association. scott i'm going to go to you you now. what we are seeing now if it is true, many suspect that the aryan brotherhood is behind the murders and for good reason. a statewide bulletin warnd that they were planning retaliation for the indightment against law

enforcement officials. what can a d.a. do in a situation like this, scott? >> well, you know, we are are telling all of our prosecutors across the country to be extra vigilant. keep an eye on your case loads and if you get a threat don't be a hero. you know, call law you enforcement and we know what to do to -- >> judge jeanine: scott, here is the problem. i was a d. a. in a county of a million people. i had a kurt detail. i was high profile. i mean i had to push them away, all right. 85% of the d.a.s in the country have offices with less than four people in it. they can't afford a security detail. and will someone please tell me whey mcclelland whose own prosecutor was killed why there wasn't a pole camera on his house? >> the reality is you have to go to work to and from the same place. most of these prosecutors as you state are from small jurisdictions and if somebody wants to kill a d.a., you are dead, that is just the reality of it. that is why we need to find

these people and find them quickly. with respect to why security was pulled from his residence? i don't know. it could have been that he was sick of it. as you know, it is not fun. >> judge jeanine: i agree. he was a a cookie and an army guy. i'm sure he told them go home. at the same time there should have been a pole camera outside his house. because they didn't do that shame on them. not him but law enforcement protecting him richard i will go to you. aryan brotherhood is a white supremacist gang. they use that to recruit white inmates but if you look white and come into the prison system you will fall under the control of the aryan brotherhood. they he have no problem working with the mexican cartels and mexican mafia. even black organizations if they have to.

so -- >> judge jeanine: go ahead. >> so we can't really say -- that is a southern poverty law center who calls everybody a nazi. that is really not their motivation. the motivation is that they are criminals. they happen to be white and they band together to protect themselves against other races. the real danger with them is that they are some of the toughest kids on the block and as such they are hired by other people to do their dirty work. for instance, when gati was incarcerated he was being extorted by the aryan brotherhood and they used black inmates to intimidate him and extract this extortion. >> judge jeanine: it is almost as though some people will, you know, kind of underestimate what their goals are. and maryanne, i will go to you you with this. hasn't the aryan brotherhood texas, you far are familiar with the prison gangs in texas. haven't they moved off of their

original mission which is why the aryan circle broke off from them? >> yes, judge. the circle broke off bought of the ideologies. they wanted a separate -- they didn't like the way the aryan brotherhood of it texas was going and so when they broke off they wanted to keep the white supremacist ideology with them. they were more for that than the abt was. >> judge jeanine: and what you are seeing is them going off their original mission. scott, the national d.a. association, what do they plan to do going forward now? is there any movement afoot to either pass laws or get more funding for the prosecutors? >> well, right now the texas district and county attorneys association is on the ground and we are working through them. we will issue a press release on monday. we, too, are going to try and raise $100,000 nationwide. money seems to work. most of all, there is a spot

you have obviously seen the reports that north korea may be making preparations to launch a missile and we are monitoring the situation closely and would not be surprised to see them take such an action. >> judge jeanine: tensions reach an all-time high as north korea warns it is set to strike. north korean officials have told diplomats to clear out by wednesday. after weeks of escalating threats, is war inevitable? joining me fox news military analyst colonel dav from boston and captain chuck nash from dak. thanks for being with us this evening. >> a pleasure, judge. >> you spent years in south korea and you are familiar with the region. the president kim jong u.n. in

the north is a young guy and the president in the south was is just sworn in four weeks ago and promises unification and the guy in the the north kim jong un is threatening to kill her and nuke us. how do we get in the middle of this? >> we have been in the middle this of since the korean conflict for 6084s. they have been make these kind of statements. they walk up to the line and back off. south korea has been attacked by north korea. the issue is north korea has -- we are in the middle of it because of a treaty at the end of the korean conflict and we he have service members stationed in south korea. 1,000 to 5 thus on the dmv which is 36 miles from north koreans. >> judge jeanine: it appears that north korea is closer to putting a nuclear warhead on a missile than iran. to they are dangerous. >> they are terrorist state sponsor of terrorism.

they blew up a nuke a week ago and they blew up one in 2006 and 2009 and they put missiles into the sea of japan. it is a dangerous place. but, nope, they cannot -- the fartherrest their missiles could reach is probably guam and we are are doing something about it. the problem is how close seoul korea is and american is service members are if the north comes south. >> judge jeanine: and captain nash reese lentently the united states and south korea have joined in military drills. is this show of force what ratcheted up tensions? >> what ratcheted up tensions, the exercise that you are talking about, judge, is a yearly exercise and every year it is the barking dog against the mailman. the mailman comes to the door, the dog barks, the exercise is over i.e. the mailman leaves and the dog stops barking and thinks that he has driven off the mailman. that is what is happening every time and every time the north has been barking and every time the south and the united states

have pretty much bent over and given them more food and relaxed some of the sanctions. well, this time what happened was they is set off a nuke, as colonel hunt just said. they also fired miss is sills into the sea of japan. we tightened the sanctions and now not only is the united states coming down hard on them, but the russians and the chinese are even starting to change their tune. so this is all ratcheted up as the colonel just said you have got a young kid who just took over in the north. he is 29-30 years old and the first female president of south korea who came in saying she didn't want to take a hardline toward korea. she wanted to take a softer more approachable line. the test is on. >> judge jeanine: it is amazing. she comes into office is sworn in four weeks ago talking about a harmonious unification and this guy, this whackaadoo is saying he is going to nuke us.

and you saw the video talking about the war mongers in the white house. our intel is telling us that the risk associated with the maneuvers is very low and yet the top u.s. commander in the south says he has never seen things so bad on the korean peninsula. what say you? >> i would say our intelligence korea. in north core ar rhea e we are limited on intent. this is a brand new whack job we have in the president of north korea. however, he has a million man army and more artillery than anybody in the world and it is all pointed at seoul korea. you have to pay attention to him. i totally agree with chuck. i don't think the u.s. is in danger. the issue you is we will be involved in any conflict if the north comes south because we put americans in the middle of it already. >> judge jeanine: and are they capable, is the north capable, on the one hand, you hear they

have old weaponry and then you say they are closer to putting a nuclear warhead on a missile. >> you know, properly motivated people can do darn near anything and beat the odds. if you look at the geography of north korea and the dmz you have funneling features and the south koreans have been working on this since 1953 as have we. if they try to come south they will lose a lot of men. the colonel is right the proximity of seoul to the dmz is the weak link in the problem and that is the north koreans have artillery dug into mountains where they have the openings they run the artillery out and fire it and they pull it back in where it is safe from attack, reload and come out and do it again and they just start pounding seoul which is the the city of 10 million people. you will have more people trampled to death than you will have killed by artillery. >> thanks for being with us

that she needed help. >> judge jeanine: that is her own mother saying she has mental problems. believe it or not the case of jodi arias the woman who stabbed, shot and slit the throat of her own boyfriend just got nuttier. in court this week the judge kicked off juror number five off the jury and as if she hasn't had enough shows up the next day to sit in the peanut gallery. with me is the author of "you can't lie to me." jeanine driver. also known as the human lie detector from d.c. fred tici and author of 'til death do us part, dr. robby ludewig. welcome everybody. to you first. what does is say when your own mother says you are crazy? >> i thought it was great she was able to say this about her daughter. it is not uncommon for families to know first hand if they have

a problematic child. i'm sure that jodi arias was suicidal and difficult within the family setting. >> judge jeanine: why are you so sure? >> ive again the family history. the fact that she had a difficult relationship with both her parents. didn't feel close with either one of them. i imagine she burned out both her parents. i'm sure they tried to help her. >> judge jeanine: does she is siblings? >> three or four, i think. >> how dom we haven't heard from them? >> you will hear from them in the death penalty phase. that will be a mitigating factor. why put her to death. if you don't is mercy on her, have mercy on the parents. >> judge jeanine: and the siblings. the parents already told us how you they feel. >> we are are going there the way the case is being tried, judge, no doubt about it. >> judge jeanine: you think there will be a verdict of guilty. >> guilty in the first-degree. >> judge jeanine: a question of whether or not they seek the

death penalty. fred, do you agree with that? >> i think jodi arias is really trying to get acquitted and in so doing it, i think she is walking h herself right into a first-degree conviction and with the death penalty. i think she is trying to manipulate the men on the jury. she was smiling when the woman got struck from the jury. a mid 30s woman. >> judge jeanine: judge throws juror number five off because the juror is talking to the other jurors apparently about the trial. is that true? >> here is what happened. the is judge interviews the jurors with respect to martinez being seen outside the courthouse taking pictures. >> being the d.a. >> right. and during the course of the interview one of the jurors happens to mention offhappenedded that the other juror said something and that is what exploded and the defense moved for a mistrial because they wanted jodi arias and they wanted that woman off the jury. >> you would too the way she has been acting now. now, you that she says somebody cajoled her to go back into the court.

quite frankly she shouldn't be sitting on the jury. >> she. >> judge jeanine: she is showing up the next day. as if you you hadn't had enough of this thing. >> we have a case of whether or not this person was killed intentionally or some lesser degree and i don't think they will find that here. the defense is partly at fault here because here obviously she got upset and annoyed after he slept her with her and felt used and caucuses boo kaboom at 30 knife wounds et cetera, et cetera and then she killed him. but saying now she is the abused victim. >> you are human lie detector. what do you think of the domestic abuse expert saying she he was abused because her boyfriend slept with another woman. >> i think it is disgusting. i'm not a fan of the expert. she is arrogant and laughing at the jury. i'm sure the jury hates their guts. the jury likes juan martinez.

this woman is a train wreck and what people are writing about h her online. listen, when i was 24 years old i had a prominent attorney outside of hartford, connecticut almost kill me, he was my boyfriend. when i announced this on national television i had over 2,000 women of domestic vie lense write to me, judge and we are all offended that jodi arias is even saying that she was -- >> judge jeanine: absolutely. i started one of the first domestic violence units in the country. i know what battered women and abused women are. this is an embarrassment. you have the juror number five who comes back into court, why? >> i love her. let me tell you, she has colored hair. it is like crazy. she was one of my favorite jurors. sat on the edge of her seat. i'm sad because she was for the prosecution. this is what i like about her are going back in court. i don't care if she is writing a book or what her goal is she is an anchor to her opinion and the people on the court know what her opinion is i'm sure. being there is an anchor.

>> you don't have to disagree with me because they will get a guilty conviction and this gives an appeal issue. she wants to be in the courtroom. let her get convicted and write her are book after. >> i think everybody is worried about the jury because the case is going on so long. one juror so interested she actually comes back into the courtroom. you can spin this either way. i think that actually helps. at one point i think mike -- my point was i thought jodi arias was going to die of old age at the rate we aring. >> that is pretty funny. >> judge jeanine: very funny, frank. robi, with the fact that you have the jury not sequestered and you have one juror tacking about this and you have the mother now saying we all know that her daughter is nuts. do you think the your errors are seeing this? >> -- jurors are seeing this? >> i do. how you could they not be interested and cure you justice scalia. they want to make sense of what they are saying and on television we have experts breaking things down. of course, they are human and curious. they are interested.

this is taking a big piece out of their life. of course, they going to watch. >> judge jeanine: they want to hear the whole story. >> they do. as a prosecutor i would not want that testimony from that mother to go in front of the jury because i would be worried about jury nullification. >> judge jeanine: saying crazy. go ahead, quickly. >> i want to tell you when it comes to murder cases on whether or not you give her the death penalty they interviewed jurors in the past and they determine by the victim and the person being prosecuted how the family members are showing up. jodi arias is laughing in court when she leaves the courtroom sometimes she takes her shoes off and is walking around bare foot outside of the courtroom. listen, travis alexander's sisters, family they are traveling in every single week and they are there for him. >> judge jeanine: you say the sympathy is did with -- how would you try the case? >> you try it not for jodi arias but for her family. you don't want to have is that mother feel like she has brought a woman into the world

to ban high capacity magazines. to you believe it? she doesn't know what she is talking about. but she wasn't the only one. president obama mixed up his facts at a big fundraiser this week when misstated the type of gun the sandy hook shooter used calling it a fully automatic weapon. joining me civil rights attorney lee row terrell my friend from l.a. and american center for law and justice executive director, jordan sekulo from new york. how does a lead sponsor of a bill in congress not know what she is talking about? is she nothing more than a robot for an ideology? >> she gaffed and made a big mistake. here are the facts. 300 million guns in the country. the state of connecticut and colorado passed gun control legislation limiting the magazine clips. there is gun nuts in the

country. a small town in georgia, i believe that is requiring people to buy a gun. judge, there is enough guns in the country. all we are trying to do is make sure the nuts don't have them. and one final point. 91% of this country has a poll out where they say we want universal background checks. there is plenty of guns in the country. >> judge jeanine: if there is such universal support for a back ground check, why are we having such difficulty getting a bill passed? >> let me guess. nra and a lot of money inside the beltway. those guys control the politicians in washington and that is the problem. it is the nra. >> judge jeanine: jordan, he says it is the nra. >> not just the mra. the fact the american people see the statement from the congress woman and say these people should not be writing the laws. they don't know what happened here in new york. cuomo did the same thing the governor, supported a magazine ban that didn't exist. you can't have a 7 shot

magazine. that is the same legislation here. what is the problem? they are not talking to anybody that has guns. there are no gun experts walking them through the proposals and then they look like they don't know what they are talking about which is a problem with all laws. >> judge jeanine: don't you agree that the laws that were changed odd haven't affected much at sandy hook? with all due respect the truth is that adam lanza stole his mother's gun. she could have gotten the gun legally with no problem. he was a nut job. why don't we have access to their mental records? >> the nra nine years ago called for european you versal background checks and -- universal background checks and now did an about face. if you reduce the capacity maybe instead of having 20 children die it could have been 18 or 16 or 15. they are trying to reduce the shooters' capability of firing the weapon over and over again.
